These Terms and Conditions of Sale to Consumers (“Terms”) govern the purchase of access licenses to the Lingopass Ecosystem by individual consumers and supplement the Terms of Use and the Privacy Policy. Supplier: LINGOPASS TECNOLOGIA LTDA, CNPJ 42.567.596/0001-56. The Consumer Protection Code (Law No. 8,078/1990), Decree No. 7,962/2013 (e-commerce), and the Brazilian Framework for the Internet (Law No. 12,965/2014) apply.
1.1. These Terms and Conditions govern the offering, purchase, and payment of access licenses acquired directly by the consumer through Lingopass’s online channels.
1.2. By entering into this agreement, you agree to these Conditions, the Terms of Use, and the Privacy Policy, as currently in effect.
2.1. Prior to purchase, Lingopass provides clear information regarding the license terms, duration, total price, payment methods, and any restrictions, in accordance with Decree No. 7,962/2013.
2.2. The consumer must provide accurate information when registering and is responsible for keeping it up to date; the email address provided will serve as the official channel of communication.
3.1. The total price, including applicable taxes, is disclosed in advance. Payment is processed through a payment provider contracted by Lingopass and may include credit card, PIX, or boleto.
3.2. Any promotional rates are disclosed in advance and applied at the time of enrollment. Lingopass may change prices and plans at any time, provided that previously completed enrollments remain unaffected.
4.1. Once payment is confirmed, access is granted within the timeframe specified at the time of purchase, using the consumer’s personal login and password.
5.1. The consumer may exercise the right of withdrawal within 7 (seven) calendar days from the date of purchase or payment, with a full refund of the amount paid, in accordance with Article 49 of the CDC.
5.2. Requests for refunds must be submitted through the channel specified by Lingopass. For credit card payments, a chargeback is requested from the card issuer; for payments made via boleto or PIX, the amount is refunded via bank transfer to the account specified by the consumer within the specified timeframes.
6.1. After the statutory cooling-off period, the consumer may request cancellation of the license, subject to the following: (i) within 180 (one hundred and eighty) days of purchase, a partial, pro-rata refund; (ii) after 180 days, conversion of the remaining balance into credit for future services.
6.2. Lingopass will confirm the applicable option and the corresponding processing time in writing.
7.1. In the event of renewal, the terms and conditions and any price adjustment will be communicated to the consumer in advance; the consumer may choose not to renew without penalty, except for services already used.
8.1. Lingopass maintains a customer service channel for questions, support, cancellations, and complaints, with response times listed on its channels.
9.1. The processing of consumers’ personal data is governed by Lingopass’s Privacy Policy, and the rights provided for in the LGPD are ensured.
10.1. These Terms and Conditions are governed by Brazilian law. The court of the consumer’s place of residence is hereby designated as the venue for resolving disputes, in accordance with the CDC.
